Terms of Use

1. Introduction

These Terms of Use govern access to and use of the AmpliFY application (the “Service”), operated by INEX BET SAS.

By accessing or using the Service, you agree to be bound by these Terms.

The Service is available to both individual users and organizations.

2. Description of the Service

AmpliFY is an AI-based software solution designed to convert 2D architectural plans into structured digital outputs, including but not limited to IFC, DWG, or RVT files.

The Service is accessible through a web interface and an API for automated workflows.

The Service operates in a fully automated manner and results depend on the input data provided by the user.

3. User Accounts

Access to certain features requires the creation of a user account.

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

You must notify us immediately of any unauthorized use of your account.

Accounts are intended for individual use unless explicitly specified otherwise under a team or enterprise subscription.

Single-user subscriptions (such as SOLO plans) must not be shared with multiple users or used concurrently by more than one individual.

We reserve the right to suspend or terminate access at any time in case of misuse, sharing, abusive behavior, excessive or abnormal usage, or violation of these Terms.

4. Acceptable Use

You agree not to use the Service for unlawful or fraudulent purposes, interfere with the operation, stability, or security of the Service, attempt to reverse-engineer, extract, or replicate the underlying models or algorithms, or bypass system limitations or access controls.

You remain solely responsible for all files and data you upload.

5. Access, Usage and Processing Priority

The Service may be accessed under different usage modes, including free access and paid subscriptions.

Processing capacity is shared across users. As a result, tasks may be queued depending on system load and processing times are not guaranteed.

Users may be subject to different processing priorities depending on their subscription level.

In particular, higher-tier subscriptions may benefit from faster processing, while lower-tier or free users may experience longer waiting times.

We reserve the right to manage processing queues at our discretion in order to ensure overall system stability.

6. Uploaded Files and Data

The Service processes files uploaded by the user in order to generate outputs.

Uploaded files, generated outputs, and intermediate data are stored temporarily and automatically deleted after processing, within a limited timeframe.

Users are responsible for ensuring that uploaded files are lawful and usable, and for avoiding the upload of sensitive or confidential information.

If explicitly enabled by the user, certain files may be used to improve the Service.

7. Output and Responsibility

The Service generates outputs automatically based on user-provided data.

Due to the nature of AI-based processing, outputs may contain errors, inaccuracies, or omissions, and may not be suitable for all use cases.

No guarantee is made regarding accuracy, completeness, reliability, or fitness for a specific purpose.

The user is solely responsible for reviewing, verifying, and validating all generated outputs before any use, including technical, legal, or operational use.

8. Scope of Use and Performance

The performance of the Service depends on the quality, clarity, and structure of the input files.

The Service is designed to operate under standard architectural conditions, but results may vary significantly if inputs do not meet expected standards.

9. Intellectual Property

All intellectual property rights related to the Service, including software, models, algorithms, and infrastructure, remain the exclusive property of INEX BET SAS or its partners.

The user retains full ownership of uploaded files and all generated outputs.

AmpliFY does not claim any ownership or rights over the generated outputs.

10. Availability and Support

The Service is provided on a best-effort basis.

We do not guarantee uninterrupted availability, absence of errors, or fixed processing times.

Access to the Service may be suspended or degraded temporarily for maintenance, updates, or infrastructure constraints.

We shall not be liable for any failure or delay resulting from causes beyond our reasonable control.

Support is provided on a reasonable-effort basis.

11. API Usage

When using the API, you are responsible for securing your API credentials and must not share or expose your access keys.

API usage is subject to fair and reasonable use.

We reserve the right to limit usage, throttle requests, or suspend access in case of excessive or abnormal usage.

12. Subscriptions, Billing and Cancellation

Access to certain features of the Service may require a paid subscription.

Subscriptions may be offered on a monthly or annual basis and are billed in advance.

Subscriptions renew automatically at the end of each billing period unless cancelled prior to the renewal date.

Users may cancel their subscription at any time through their account settings or through the payment provider.

Upon cancellation, access to the paid features remains available until the end of the current billing period, and no further charges will be applied after that period.

All payments are final. Except where required by applicable law, no refunds or partial refunds are provided for unused time, partial periods, or unused features.

Payments are processed by third-party payment providers, including Stripe. We do not store or process payment card details directly.

We reserve the right to modify pricing at any time. Any changes will apply at the next billing cycle or renewal date.

13. Limitation of Liability

The Service is provided “as is” without warranties of any kind.

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, and shall not be liable for any damages resulting from the use of the Service or from decisions, actions, or outcomes based on generated outputs.

Users acknowledge that the Service is an assistive tool and does not replace professional judgment, verification, or validation.

14. Modifications

We reserve the right to modify the Service or these Terms at any time.

Continued use of the Service constitutes acceptance of the updated Terms.

15. Termination

We reserve the right to suspend or terminate access to the Service at any time, without prior notice, in case of violation of these Terms, abusive or harmful behavior, or risk to the platform or other users.

Where appropriate, we may also implement technical restrictions, including access blocking measures.

16. Governing Law

These Terms are governed by French law.

Any dispute shall fall under the jurisdiction of the competent courts of France.
